The term (CLIENT) will be used when referring to the parent or parent(s) who will execute this agreement to work with the consultant in providing services for the student in the placement in school or program. THE AGREEMENT This agreement is to a pay a fee for service for the purpose of placement in a school or to discuss options on a program. The agreement also includes: the placement fees associate with or incurred by the consultant in the placement process. This does not include: the school tuition or registration in a program. Based on recommendations by the consultant, the client will review the contract agreement, and discuss charges or fees related to this placement: visiting a school or program, discussing the options which they have regarding a school or program and any cost incurred related to the final placement of the student. The parent agrees: after discussion with the consultant or consultants(s) that the services will be provided, will establish the relationship between the parent and student and the consultant. The consultant agrees to not have any multiple relationships between any other consultant and service which would be in conflict with the parents interest. The consultant cannot guarantees that the student will be accepted in a school or program, but agrees upon being retained by the parent, has informed the parent and the student of the agreement and both the consultant and the parents accepts the services based on the relationship discussed in the contract. The CLIENT having full knowledge of this agreement also accepts the conditions, having full knowledge and willingness to be provided services, in accordance to the ethical practices, established the Code of Good Practices developed by the Independent Educational Consultants Association, and holds the consultant harmless in unethical practices. However, the consultant in agreement to these practices will abide to guideline of this Code. . The CLIENT (s) acceptance of this contract being made known of the condition by the consultant, will agree to the condition of the placement of the student in a school and program based on the admission policies or conditions of the school or program. The CLIENT also agrees to allow Educational Planning and Counseling Services to provide assistance to each of the CLIENT (s) or student in the placement; which includes: selection of an appropriate school or program and fees associated with the placement established solely by Educational Planning and Counseling Services The CLIENT will also be informed of any additional fees by the consultant as it applies to the placement. The following fees will include: requesting educational records, for review by the consultant and researching a school or program, correspondence with the CLIENT or any other professional to discuss the placement options, arranging a tour of the school, placement by the consultant, and any related fees of doing business. Those fees associated with the placement also include: correspondence with schools, faxing or telephone correspondence, or electronic messaging, travel, arranging a tour visit by the consultant for the parent or student, ongoing correspondence between the family and other services requested by the client to address the placement... The CLIENT also agrees to meet with the consultant to discuss the details of the contract and expenses therein. The CLIENT agrees to allow the conditions stated in the contract .Fess which are excluded in these services will be discussed by the consultant at the time of the agreement (tuition, registration at a school, mailing by the school and fees which are incurred by the school or other services outside the consultant fees. Any separate fees not covered in the contract will be discussed with the parent(s) at the time of the initial contract agreement, and will not be included in this contract agreement. The fees not included in the placement will be those fees which are not covered in the practice agreement between the consultant and the parents. This agreement will not include: liability by a transport service for a student to a program or any health related expenses, which are normally covered by the parents in a medical or health care plan. Most parents have health care insurance for their child and this is not covered in the contract by the consultant. The consultant does have liability insurance covering any liability issues of practice up to 3 million dollars in coverage. The CLIENT (s) needing psychological testing or educational testing before entering a program will be discussed by the consultant before the placement and an appropriate referral made. The consultant will discuss tuition and registration fees with the parent or CLIENT at the time of the contract agreement. The parent will be informed by the consultant of these cost and arrangements with the school. All transcript records or student records of attendance will be requested before the time of placement as part of admission to a school or program, along with being informed of the registration or tuition cost. Any transition fees associated with transition from one program to another will also be discussed prior to the placement. When a student is placed in a school or program by the parent without the agreement between the consultants, the consultant will consider this a breach of contract. The consultant will work with the parent and student until the suitable placement has been established. The fees associated with boarding school and therapeutic boarding school placement will be discussed with the parent. Fees for in state and out of state placement or transition, international or college placement will also be discussed. A student who is not a good fit for a program or school will be discussed by the consultant and the parents at the time of entering the contract agreement. A student determined by the consultant and schools to be a poor fit, or not able to enroll in a school, will be reassessed by the consultant. For example: if a student refuses to go attend a school or program, or the parent is not accepting the school as a good match, or the school refuses admission to a program the consultant will continue to work with the CLIENT as long as there is an agreement between the consultant. However, in a situation where the student still might be a good fit and the parent is not in agreement with the consultant, we discuss the placement with both. We will not insist that students attend a school or program but there are situations which might be in the best interest of the student and the parent. In this situation if the parent agrees to the judgment by the consultant for the placement based on reviewing the circumstance for the placement and the availability for the placement, the consultant will make the recommendation to the CLIENT... A CLIENT who is dropped from a program or expulsion from a program was the result of non compliance to rules in a school or program polices, or his/her behavior at a school was not acceptable, to the school the consultant will continue to work with the parents to find a suitable placement in another school or program. The CLIENT who is in transition program will not be charged a fee unless they are in breach of the contract agreement. However, the consultant has the right to discontinue services, if the student leaves the program without the consent of the school or parent takes the student from the program, or is a runs away from a program This is applicable to mostly therapeutic boarding school placements. The agreement will be honored, as long as there is a placement opportunity available and the student or parent agrees to the placement. The agreement no longer exists between the parent, student and the consultant if the agreement is breached by the student or the parent. Programs that have restrictions also apply to the contractual agreement with the consultant there is no agreement between the school and the consultant for fees associated with the school or placement after breaching the contract agreement. When there is a scholarship or a reduction in tuition or increase in tuition the parent will be notified by the consultant. RETAINER FEE THE CLIENT(s) having agreed to the established fee or fees (s) will pay a retainer fee of ($500.00) (Five hundred- dollars). This fee will be requested by the consultant at the time of entering the agreement. This final fee will cover the final placement and does not include the initial retainer fee, addressed in the contract. This retainer fee does not applies to international placement, which requires full payment of all fees including the retainer fee at the time of retaining services, in this case all fees must be paid in advanced. THE PLACEMENT FEE A placement fee of ($4,500.00) four thousand five hundred dollars will be established as the fee for individuals living in the United States or outline territories of the United States which would include: the US Virgin Islands. Guam, Hawaii. This fee applies to students who are placed in a boarding school or therapeutic boarding school within these states and territory designated as US territories. Any student or individual living outside the state will be charged a fee which is separate of this fee identified in the contract agreement in case management and follow-up. The fee is based on fees incurred by the consultant in doing business. DEFINITION OF DOING BUSINESS The term doing business applies to any and all services provided by the consultant OR THE BUSSINESS in exchange for payment by the CLIENT which is described in the contract agreement The consultant will spell out the fees which will be discussed with the parent at the time of entering the contract agreement. FEES FOR A STUDENT WHO TRANSITIONS IN PROGRAMS When a student transitions from one program to another a fee is charged ($1,500) will be added to the current placement fees Private school placement fees will also apply to the same options when a CLIENT request to move to a private school from a regular boarding school or in a therapeutic boarding placement and transition from a wilderness program to a therapeutic school placement. CLIENT ACCEPTANCE OF FEES BY THE CONSULTANT The CLIENT cannot offer fees in exchange for services. The fess is established and reflects the business relationship with the CLIENT and the consultant. The consultant does not accept any form of payment by the school in exchange for services provided by the CLIEN or the school REFUND POLICY The CLIENT may request a refund for services, if the agreement between the consultant and the parents or student has not been breached. This means, that if the parent is not in agreement with the consultant regarding services or fees provided, or the consultant fails to provide the services as stated in the contract agreement, the parent or student may request a full refund. This refund request must be in writing to the consultant within 10 days from the date the student receives acceptance in the school or program. The consultant can make the refund immediately when charged to a credit card by the credit card processing company which Educational Planning and Counseling Services has agreed to obtain the payment source for refund through. A check or money order or electronic transfer can be made through the company. The agreement with the CLIENT for full refund for payment for services is based on the conditions outlined in the refund policy. A CLIENT(S) requesting a refund for services based n the current contract agreement must comply with the refund policy. INTERNATIONAL STUDENTS International Student placement will cost ($4,500) International students fees are established based on placement, not based on non-associated business. The parent cannot negotiate the fees by the consultant for an international student based on where the parent wants the student to be placed. The consultant will agree with the parent to place the student if the placement is a correct placement option. This will be determined by the parent and the consultant at the time, when working with the CLIENT. A student who is not a legal immigrant needs to obtain the necessary documentation by the immigrations officer or consulate permitting application for a school. An I- 20 Visa must be submitted for application to a boarding school or program or college. This application can be done with the school and the consultant. These fees are NOT negotiable with the consultant or associated with consultant or the school the international student or parent or guardian or consultant does not determine this status of admission or school acceptance based on the immigration status. The school will work with the consultant and the parents in the placement application. Each school varies regarding both the application process and the acceptance of international students therefore the consultant will advise the CLIENT of admission criteria and polices for international students. . International students must have a student visa or I-20 Visa to be granted by the visiting country to study abroad and agreed by the United States State Department Immigration and Naturalization and US State Department. The CLIENT who is not been granted international student admission status will be advised by the consultant prior to acceptance in a school or program. The policies of the school or program require compliance to the immigration law. The parents agree to share this information with the school prior to review for acceptance in a school or program. The parent also agrees at if any information is not true and accurate and the information is concealed by the parent or student this is considered a breach of contract. Therefore, ANY information related to the application process as it applies to the student or the application process must be discussed with the parent. Student requesting services for application to a school must allow the consultant to work with the school to provide the necessary information and inform the parent of the policies and compliance with all immigrations issues laws. A student, who is an international student and needs case management, will be charged a fee of (800.00) per month in addition to the fees for the placement for monthly visits to a school or program. MILITARY PARENTS WHO ARE BEING DEPLOYED AND REQUESZING SERVICES IN SCHOOL PLACEMENT A CLIENT who has a child who needs placement in a school or program by a military personal must inform the consultant of the approximate date of deployment and the designated guardian of the student when a student is placed in a boarding school. The consultant will make arrangement with the parent to address the placement options and the contact information needed. The base where the officer is stationed will also be informed of the student placement along with the commanding officer. The Educational Consultant will charge a fee for case management of the student on a month basis ($800.00) per month for the services to keep the parent informed of the placement and the needs of the student. The boarding school or therapeutic boarding school or college will be contacted by the consultant to address any areas of placement needed by the parent or student within a reasonable time frame. Most military parents need at least 3 months for all documents to be processed. This also includes international students. When travel is needed to complete this document the consultant will advise the parent and make arrangements to address the student placement. All contractual agreement applies to ALL international students regardless of placement or school. There is no variance in consultant fees for a school or program within the continental United States or Canada or other countries. The CLIENT fees are established for all territories of the United States and all fees apply all countries and international students based on US currency. The CLIENT (s) will be made aware, that there is no guaranteed acceptance or denial in a school or program and that payment is the same for all students for our services. Payment can only be made in US Currency. CONFIDENTIALITY All school records can be obtained with an agreement by the parent and student and consultant, the agreement with The Family Rights and Education Act. (FERPA) (20 U.S.C. 1232g; 34 CFR. This information will be obtained by a written release from the student or parent for records needed for the placement. The consultant will offer a release form to the CLIENT (S) in obtaining information from a school or program. This information is held has confidential between the school and the consultant and the parent. The CLIENT agrees to allow the consultant to obtain the necessary information from the student, parent or legal guardian. This can include: from the previous school or current school of interest and present or past schools. ALL information will be held in confidence and: academic records, psychological reports, attendance and court records will not be obtained without the consent of the parent or legal guardian, RELEASE OF INFORMATION The CLIENT who agrees to share any information, with the consultant or schools must have a release form THE PARENT OR GUARDIAN. The consultant will discuss the INFORMATION with the parents and the consent or release of information agreement. The consultant will also share any information with the parent regarding school placement and records for the purpose of addressing his school placement. . Tuition and record fees are separate fees related to the school. School records or medical records can be shared with other program or admission officers and guidance counselors at the school and the educational consultant. The CLIENT agrees to share information with the consultant. CLIENT(s) voluntarily leaving a program or parents request termination from a program, must advise the consultant before leaving the program. Termination of this agreement means termination of the contract between the consultant and the parent and the student. The CLIENT agrees that there is no reimbursement for fees or services to Educational Planning Services when a student pulls out of the school program or if the student leaves the school. Dismissed from a program or school due to behavior or academically poor performance does not receive reimbursement for fees incurred or related to the placement by the consultant. Fees can reimbursed is not refundable to the consultant for services. The consultant is not responsible for termination of the contract between the schools. TERMINATION FROM A SCHOOL OR PROGRAM A student who is terminated from school or program must be advice by the parent during the agreement. The student must follow the guidelines established by the admission policy of the school. The CLIENT must notify the consultant of any suspensions in writing. Termination of a student from a school or program for any other reason not addressed in the school policy or a breach of the contract agreement means termination of the contract agreement by the consultant and the parent or student. . The parent must advise the consultant in writing or email or by calling the consultant. The consultant will not terminate the contract with the parent or student when there is not a conflict of interest identified by the consultant. A conflict of interest by the consultant would include: the parent provided false information to the consultant, regarding the student or was in violation of the law regarding immigration or in violation of the city, state or local ordinances PAYMENT FOR SERVICES Payment for placement can be made payable to the following address. Any misrepresentation of the citizenship by a parent or student will result is discharge of services Any CLIENT who does misrepresent themselves will receive a letter from the consultant, indicating the reason for being discharged of services. Any CLIENT who request services, by misrepresenting themselves or their intent in our services by a contractual agreement being made, and then, breaching the contract by seeking or hiring another consultant at the same time while under our services will also is discharged from the contract. PAYMENT IN ADVANCE OR PAYMENT WITH A LENDERS Fees can be paid in advanced by the parent either checks or money order. The leading institution, which provides the loan, can also send the payment directly to the consultant. Fees for each school will be disclosed to the parent and student by the consultant prior to the time of placement. Any application fees will be discussed and financial aid or placement cost or scholarships will also be reviewed by the consultant and the parent or the student. The CLIENT agrees upon entering into this contract agreement will be the responsible parties(s), as signed, according to the agreement shall be made aware of ALL services at the time of entering into this contract. This agreement executed as the effective date will be governed by the State of Arizona and Maricopa County shall be sole and exclusive form of resolution of all disputes arising for this agreement.
